Terms of Service

These Terms of Service ("Terms") govern your access to and use of pamelahobbsrealestate.com and any services offered through the Site by Pamela Hobbs Real Estate and Design ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Us

Pamela Hobbs is a licensed Arizona real estate agent. Real estate brokerage services are offered under her sponsoring brokerage as required by the Arizona Department of Real Estate. Design, remodeling project management, and home staging services are offered separately and are not regulated brokerage activities.

2. Informational Use Only

All content on the Site — neighborhood descriptions, market commentary, pricing ranges, FAQs, blog posts, the Strategy Guide, and any free resources — is provided for general informational purposes only. It is not legal, tax, financial, accounting, or investment advice. Real estate, tax law (including 1031 exchanges), and lending rules change; verify current details with a licensed professional before acting.

3. No Agency Until Engaged

Submitting a contact form, downloading a resource, or exchanging messages does not create an agency, fiduciary, or client relationship. A real estate agency relationship begins only when you and Pamela sign a written representation agreement (buyer-broker agreement, listing agreement, or equivalent).

4. Listings & Market Data

Property listing data, photos, and market statistics shown or linked on the Site are sourced from the Arizona Regional Multiple Listing Service (ARMLS) and other third-party providers. We strive for accuracy but make no warranty as to completeness, timeliness, or correctness. Listings are subject to prior sale, change, or withdrawal without notice. Always confirm property details with the listing agent before relying on them.

5. Equal Housing & Fair Housing

We are committed to the letter and the spirit of U.S. policy for the achievement of equal housing opportunity. We do not discriminate based on race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, or any other class protected under federal, Arizona, or local fair housing law.

6. Intellectual Property

All content on the Site — text, graphics, logos, photography of Pamela, the Strategy Guide, video, and design — is owned by Pamela Hobbs Real Estate and Design or licensed to us, and is protected by copyright and trademark law. You may view and print pages for personal, non-commercial use. Reproducing, republishing, scraping, or redistributing content without our written permission is prohibited.

7. User Submissions

When you submit information through a form, message, or review, you represent that the information is accurate and that you have the right to share it. You grant us a non-exclusive, royalty-free license to use the content of your testimonials and reviews for marketing purposes, with attribution by first name and last initial unless you tell us otherwise in writing.

8. Third-Party Links

The Site links to third-party websites (Google Maps, Zillow, Realtor.com, social profiles, lender or contractor partners). We do not control and are not responsible for the content, accuracy, or privacy practices of those sites. Visit them at your own risk.

9. Communications Consent

By providing your phone number or email, you consent to receive transactional communications (responses to your inquiry, scheduling, transaction updates) and, if you opt in, marketing communications by phone, text, or email. Standard message and data rates may apply for SMS. Reply STOP to opt out of texts or use the unsubscribe link in any marketing email.

10. Disclaimer of Warranties

The Site and all content are provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Pamela Hobbs Real Estate and Design and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Site or reliance on Site content. Our total liability for any claim arising from the Site will not exceed one hundred dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Pamela Hobbs Real Estate and Design from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any third-party right.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top of this page reflects the latest revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
